3.  Processing purposes and legal bases when visiting our website

MSK guarantees the protection of your privacy when processing personal data and the security of any business data in compliance with legal requirements.
When you visit our website, it is unavoidable that certain—primarily technical—information will be collected which may be classified by law as personal data. The collected data includes your IP address, device identifier, browser, operating system details, language settings, referrer URLs, the length of your visit and displayed pages.

3.1 A technically functional and user-friendly website is provided and anonymized statistical assessments are performed on the legal basis of Article 6(1)(f) of the GDPR. We cannot identify you when using this information.

3.2 In case of cyberattacks, we are required by law to provide certain information to law enforcement authorities, legal basis (Article 6(1)(c) of the GDPR).


3.3 If personal data is necessary for the conclusion or performance of a contract or for steps prior to entering into a contract, this will be done on the legal basis (Article 6(1)(b) of the GDPR).


3.4 Personal data will only be processed for other purposes with your consent, legal basis (Article 6(1)(a) of the GDPR).


3.5 If processed for purposes for which consent is not necessary, personal data will only be transferred to MSK Group subsidiaries and to the hosting service provider hosting our website on our behalf.
The period for which data is stored varies depending on the purpose and legal basis. We plan to store data that is processed for purposes for which consent is not necessary for 7 days after which it will be deleted.
We intend to transmit data to our branches in the US and in China—third countries outside of the European Economic Area. 4.    Contact form

We offer you a contact form to contact us on a voluntary basis. The use of the contact form is not necessarily required for the use of our website. Insofar as you use our contact form, we collect your name*, the country from where you contact us*, your email address*, the company, your telephone number and the content of the message. The data marked with an (*) are mandatory, i.e. the contact form cannot be sent without stating these data. The specification of the other data is voluntary, i.e. a successful sending of the contact form is also possible without stating these data.

We use these data to answer your query. With the processing of the data, we pursue the legitimate interest of answering your queries (Article 6(1)(f) General Data Protection Regulation). Furthermore, under the trade and tax law regulations we are obligated to archive (Article 6(1)(c) General Data Protection Regulation).
We plan to archive the above data for a period of 10 years and to  delete them after that period.
Depending on the type of enquiry, any disclosure of the data takes place to other companies of the MSK group of companies and to our hosting services provider, who hosts the website on our behalf. They are not passed on to third parties.

5.    Electronic applicants portal

We offer you an electronic applicants portal. The use of the applicants portal is voluntary and not required for the use of our website. You can also apply via other channels (e.g. by post). If you register in our electronic applicants portal, we will additionally process your name*, your address*, your telephone number*, your email address*, your date of birth, your nationality, your language skills*, your willingness to make business trips and any titles. Furthermore, you have the option to upload a cover letter, your CV and references. The data marked with an (*) are mandatory, i.e. without stating these data, a successful registration in our applicants portal and therefore the submission of an electronic application are not possible. The specification of the other data is voluntary, i.e. a successful registration is also possible without stating these data.

The data are used by us for the purpose of deciding on the conclusion of employment contracts (Section 26(1)(1) Federal Data Protection Act and Article 6(1)(b) General Data Protection Regulation). With the processing of the data, we also pursue the legitimate interest of processing and answering your application (Article 6(1)(f) General Data Protection Regulation). Furthermore, under the trade and tax law regulations we are obligated to archive (Article 6(1)(c) General Data Protection Regulation).
The data are processed by employees of our HR department. Depending on the job opening, any disclosure takes place to other companies of the MSK group of companies and to our hosting services provider, who hosts the website on our behalf.
A transmission to third countries outside of the European Economic Area is not intended, unless the application relates to vacancies that are linked to our branches in the United States of America and/or the People's Republic of China; in this case, the enquiries are forwarded on the basis of the EU standard agreement clauses to the relevant company of the MSK Group, which can be accessed at the address http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:32001D0497:EN:HTML
We delete the data regularly within 6 months after refusal or completion of the application process.

 

6. 1   Google Analytics

We have integrated the component Google Analytics on this website (and activated its anonymization function). Google Analytics is a web analysis service. Web analysis means collecting, compiling and assessing data about the behavior of website visitors. Among other things, web analysis collects data about the websites from which data subjects reached another website (so-called referrers), which subpages of the website were accessed or how often and for how long a subpage was viewed. Web analysis is used to optimize websites and perform cost-benefit analyses of Internet advertisements. The provider of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA (hereinafter “Google”). When conducting web analyses via Google Analytics, we use the addition “_gat._anonymizeIp”. This addition makes Google shorten and anonymize the IP address of your Internet connection when accessing our website from the European Economic Area.
The purpose of the Google Analytics component is to analyze the flow of visitors to our website (legal basis: Article 6(1)(a) of the GDPR). Google uses the obtained data and information on our behalf to, among other things, assess the use of our website, prepare online reports for us that show activity on our website and to perform other services related to the use of our website.
Google Analytics will place a cookie on your computer. We will explain what cookies are again in detail in Section 9 below. Cookies allow the use of our website to be analyzed. When you access any page on our website, the respective Google Analytics component makes the browser on your computer transmit data to Google for online analysis purposes. As part of this technical procedure, Google will, on our behalf, learn personal data, such as your IP address, which is used, among other things, to determine the origin of visitors and clicks.
Cookies are used to store personal information, e.g., the time of access, the location from which our website was accessed or the frequency of visits to our website. Every time you visit our website, this personal data, including the IP address of your Internet connection, will be transmitted to and stored by Google in the US. Google may transfer personal data obtained via this technical procedure to third parties.
The data subject may disable cookies on our website, as explained in Section 9, at any time through corresponding browser settings and may thereby permanently refuse cookies. 6.2   Hotjar

To better understand the needs of our users and optimize this website, we use Hotjar. Hotjar’s technology allows us to better understand our users’ experiences (e.g., how much time users spend on which pages, which links they click on, what they like and what they don’t, etc.). This helps us base our offer on our user’s feedback. Hotjar uses cookies and other technologies to collect information about our users’ behavior and their devices (especially their device’s IP address (only collected and stored in anonymized form), screen size, device type (Unique Device Identifiers), information about the browser used and location (only country) to display our website in the preferred language). Hotjar saves this information in a pseudonymized user profile.
This information is not used by Hotjar or us to identify individual users or merged with other user data.

7.    Google Maps

The plug-in of Google Maps is embedded in this website. The operator of Google Maps is Google.
By each retrieval of the individual pages, in which Google Maps is integrated, the internet browser on your computer is automatically initiated to send data to Google for the purposes of the provision of the Google Maps plug-in. Within the framework of this technical procedure, Google learns of personal data, such as your IP address, which serve, among other things, to establish the origin of the visitors and clicks. In particular, the IP address, device identification, browser features, operating system details, language settings, referring URLs and geolocation data are sent to Google.
The purpose of the Google Maps component is our legitimate interest to present static map graphics to you.
With suitable browser settings or plug-ins you can prevent that page elements such as Google Maps are loaded automatically. If you use such settings or plug-ins, the map presentation of Google Maps is displayed not at all or only after your express release depending on your settings; only then is the above data transmission to Google made.
Within the framework of Google Maps, we do not store any personal data.
A transmission of the personal data to other recipients does not take place.

8.    YouTube player

We have integrated components of YouTube on this website. YouTube is an internet video portal that enables video publishers the free placement of video clips and other users the also free viewing, rating and commenting of them. YouTube permits the publication of all kinds of videos, for which reason both complete film and TV shows but also music videos, trailers or user-created videos can be downloaded via the internet portal. The purpose of the embedding is our legitimate interest to present our products to you on our website (Article 6(1)(f) General Data Protection Regulation).
The operator of YouTube is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA (here: “YouTube”). YouTube is subsidiary of Google.
On each retrieval of an individual page, on which a YouTube component (YouTube player) was integrated, the internet browser on your computer is automatically triggered to download a presentation of the corresponding YouTube component from YouTube. Further information on YouTube can be accessed at https://www.youtube.com/yt/about/en/. Within the framework of the technical procedure, YouTube and Google learn about what specific subsite of our website you visit.
If you are simultaneously logged in at YouTube, YouTube will recognise on the retrieval of a subsite, which contains a YouTube video, what specific subsite of our website you are visiting. This information is collected by YouTube and Google and allocated to your relevant YouTube account.
YouTube and Google receive via the YouTube component information that you have visited our website if you are simultaneously logged into YouTube at the time of accessing our website; this occurs regardless of whether you click on a YouTube video or not. If you do not want such a transmission of this information to YouTube and Google, you can prevent the transmission by logging out of your YouTube account before calling up our website.
You can also prevent the establishing of an automatic connection at any time with corresponding settings of your internet browser used; our site will then still be usable, albeit without videos.
The data protection provisions published by YouTube, which can be accessed at https://www.google.de/intl/en/policies/privacy/, provide information on the collection, processing and use of personal data by YouTube and Google. Within the framework of YouTube, we do not store any personal data. A transmission of the personal data to other recipients does not take place.

 

9.    Cookies

This website uses cookies. Cookies are small text files that are placed on your computer when you visit our website. Cookies cannot harm your system and do not contain viruses. Cookies are used to make our website more user-friendly, effective and secure. Many cookies include a so-called cookie ID in the form of a unique short series of characters. This cookie ID may be used to identify a specific browser. When accessing our website, we display a so-called “cookie banner” on which you, by activating the corresponding button, consent to the use of cookies and may select the cookies to be used on this website. Your selection will be saved for future visits. We plan to save it for 6 months after which it will be deleted.

You also have the right to demand a correction, deletion or limitation of the processing of the personal data stored about you. As regards the processing of your personal data due to our legitimate interests, you have the right to object to the processing of your personal data at any time for reasons that arise from your personal situation (Article 21 General Data Protection Regulation). In addition, you have the right to file a complaint with the supervisory authority if you are of the opinion that the processing of your personal data violates applicable data protection laws.
